Brendan McKay and Erica Jozwiak prevailed on behalf of the insurance carrier in a two day jury trial in Hillsborough County.
This was a breach of contract case over whether the carrier paid the right amount under the policy with the insured for the windshield replacement. The Plaintiff was an auto glass company that took an assignment of benefits from the insurance carrier’s insured.
The jury returned a verdict finding that the insurance carrier paid the right amount for the windshield replacement and did not breach the insurance contract with their insured.
